New Delhi: Out of 5 crore cases, 4.3 crore, i.e more than 85% cases, are pending in district courts across India as of December 2022. Government itself is the biggest litigant and accounts for 50% of the pending cases.
The court cases are categorised into two types – civil and criminal. In 2022, the total number of pending cases of all types and at all levels rose to 50 million or 5 crores, including over 169,000 court cases pending for more than 30 years in district and high courts.
Newsroom24x7 would like to cite one case pending in the High Court of Madhya Pradesh.
Successive governments, cutting across party lines, flout the law of the land with impunity when they want to serve the vested interests. There is need for generating awareness among the people in this regard. They should know about the commitment or lack of commitmen of successive governments when it comes to protecting wildlife. The nomination of members to the State Wildlife Board is a case in point. Those concerned, are raising a valid point by asking about “the credentials of those who get nominated to the high powered wildlife Board by the State Government”.
A case in this matter is pending in the Jabalpur High Court. The issue was flagged by an earlier Chief Justice, who allowed revision of the original petition and chose to keep the case open even after the Board appointed by the previous Kamalnath government had been disbanded and it was reconstituted in the year 2000 by the present government headed by Shivraj Singh Chouhan. The Chief Justice had observed that it needs to be ascertained whether or not the statutory provision under the Wildlife Protection Act has been followed and only eminent conservationists, ecologists and environmentalists had been nominated as members of the reconstituted Board.
This case filed in the year 2019 is still pending in the High Court.
